- A: This flag indicates whether the Guardian/Conservator is also serving as the representation payee for the Social Security Administration or Veterans Affairs. In other words, is the Guardian/Conservator also receiving the payments on behalf of the individual they are responsible for related to the case. Ref: https://www.ssa.gov/payee/ and https://www.benefits.va.gov/fiduciary/fiduciary.asp for the programs referenced in the NODS definition.
Events: - "Directed Verdict"
- A: This flag indicates whether any part of the verdict was directed. A directed verdict is a ruling entered by a trial judge after determining that there is no legally sufficient evidentiary basis for a reasonable jury to reach a different conclusion.
Docket Tab: - "Filing Party" - need more information on what data to enter
- A: The filing party may be captured by name or by the relationship to the case. For purposes of the survey, indicate which value could be provided, or both. The final CCIS 4.0 ICD will specify which value(s) to provide, and applicable formats.
- "Out of State Indicator"
- A: This flag indicates whether the Docket was filed by an entity outside the state of Florida
- "Restraining Order Indicator"
- A: This flag indicates if a Docket is a restraining order. There are existing docket codes that this may be derived from. This flag would support ease of reporting and visual indicators in the CCIS user interface.
- "Docket Type Flag"
- A: Like the Restraining Order Indicator, this value could be derived from existing docket codes and would support the ability to support visual indicators in the CCIS user interface. For example, a gavel next to judgement dockets or dollar signs next to financial obligation dockets.
NODS Tab: - "Defendant Status Bond Code"
- A: NODS does not provide a formal definition. The working definition for this exercise is to indicate whether the defendant posted bond, or is in default
- "Referral Date"
- A: This field is related to Pre-Trial activities tied to Juvenile cases. The date represents when the incident was submitted for an intake decision.
- "Referral Source Type"
- A: This field is related to Pre-Trial activities tied to Juvenile cases. The source type indicates the ‘agency or person that referred the incident.’
- "Referral Source Detail"
- A: This field is related to Pre-Trial activities tied to Juvenile cases. The source detail is ‘the specific agency or person that referred the incident to court.’
- "Diversion Exit Type"
- A: From NODS, the diversion exit type indicates why the person left the diversion program.
- Successful completion includes graduating or receiving a successful discharge from a program.
- A neutral value indicates that the participant did not successfully complete the program requirements but exited the program without prejudice (e.g. as result of death or illness). These are often termed “administrative discharges.”
- An unsuccessful exit indicates that the person left the program with prejudice, without completing the program requirements.
